Our Labor & Employment practice includes the following key areas:
- Labor Advice: We offer legal counsel and advisory services on labor and employment matters, including the drafting and review of employment agreements, internal policies, and compensation plans; guidance on different types of employment arrangements, outsourcing, working hours, occupational health and safety; and legal support during hiring, employee transfers, and terminations. In collaboration with our international partners, we also assist with issues involving the global mobility of Brazilian and foreign employees.
- Judicial and Administrative Litigation: We represent clients in labor litigation, with a focus on strategic portfolios and complex, high-stakes individual and collective lawsuits. We also have specialized experience before the Superior Courts in Brasília and in labor arbitration, working alongside our Civil Litigation and Arbitration practice. Our services further include administrative labor proceedings, such as investigations initiated by the Labor Prosecutor’s Office and proceedings arising from citations issued by the Ministry of Labor and Employment. We also provide support in mediations and negotiations with labor authorities and unions, assist with out-of-court settlements, and offer legal support in voluntary jurisdiction proceedings for judicial ratification of agreements.
- Union Negotiations: We manage labor union relations, participate in collective bargaining processes, and assist with the drafting and review of Collective Bargaining Agreements.
- Executive Hiring and Incentive Plans: In collaboration with our Tax and Corporate practice, we advise on the design of variable compensation plans for employees and executives (such as profit-sharing plans, stock options, and RSUs). We also provide legal support in the hiring and termination of executives.
- Due Diligence, Investigations, Training, and Legal Operations: We assist in corporate transactions by conducting labor audits and aligning employment benefits. We also support the implementation and review of labor compliance programs, deliver training on harassment prevention, and participate in corporate investigations. Additionally, we assist in optimizing legal departments through improved management of legal documents, information, and workflows.
