

Appealing to the STJ may become more expensive as of next year.
The Superior Court of Justice approved new criteria for the collection of court fees, which will come into force on January 1, 2027.
The change regulates Law No. 15,498/2026, which amended the STJ’s court fee system and authorized, as a general rule, the adoption of percentages ranging from 2% to 4% of the updated amount in dispute. Until then, the calculation was based on fixed amounts, periodically adjusted for inflation, without directly considering the economic value of the proceedings.
In the case of a special appeal, for example, the court fees will correspond to 2% of the updated amount in dispute, subject to a minimum of BRL 1,325.45 and a maximum of BRL 107,332.80. When there is no defined economic value, fees will continue to be charged based on fixed amounts.
The regulation preserves the statutory provisions for legal aid and exemption from court fees.
The new rules represent a significant change in the system for paying court fees in proceedings submitted to the Court and should be taken into consideration when planning the filing of appeals and original actions as of 2027.
