In light of this, our partner Bruno Corr\u00eaa Burini prepared content in a question-and-answer format on the subject.<\/p>\n<p data-start=\"434\" data-end=\"600\">Understand who may submit a refund request, which entries must be submitted, what data must be provided in the declaration, and other details by accessing the images.<\/p>\n<p data-start=\"602\" data-end=\"730\"><strong>Who may submit a refund request (CAPE Declaration)?<\/strong><br \/>\nThe importer of record or the customs broker who originally filed the entry.<\/p>\n<p data-start=\"732\" data-end=\"1038\"><strong>Which entries may I submit?<\/strong><br \/>\nImporters may, in general, submit CAPE Declarations for:<br \/>\n\u2022 Entries that have not yet been liquidated<br data-start=\"860\" data-end=\"863\" \/>\u2022 Entries that were liquidated up to 80 days prior to the submission of the CAPE Declaration (for example, since January 30, 2026, if the declaration is submitted on April 20)<\/p>\n<p data-start=\"1040\" data-end=\"1482\"><strong>CAPE will not accept declarations for:<\/strong><br \/>\n\u2022 Entries flagged for reconciliation, as well as Entry Type 09 \u2013 Reconciliation Summary<br data-start=\"1166\" data-end=\"1169\" \/>\u2022 Entries included in drawback claims<br data-start=\"1206\" data-end=\"1209\" \/>\u2022 Entries covered by an open protest<br data-start=\"1245\" data-end=\"1248\" \/>\u2022 Entries not recorded in ACE or without liquidation status in the system<br data-start=\"1321\" data-end=\"1324\" \/>\u2022 Entries subject to antidumping or countervailing duties (AD\/CVD) still pending liquidation in accordance with instructions from the Department of Commerce<\/p>\n<p data-start=\"1484\" data-end=\"1644\"><strong>What about other entries?<\/strong><br \/>\nCBP expects to release future CAPE updates to cover entries not included in Phase 1. However, there is currently no timeline for this.<\/p>\n<p data-start=\"1646\" data-end=\"1889\">In the meantime, we recommend filing protests as close as possible to the 180-day deadline following liquidation (generally within the last 30 days). This helps preserve the company\u2019s legal rights while CBP implements new CAPE functionalities.<\/p>\n<p data-start=\"1891\" data-end=\"2162\"><strong>What data must be submitted in the CAPE Declaration?<\/strong><br \/>\nCAPE will require only the submission of a .CSV file containing the list of entry numbers for which a refund is requested. Each file may contain up to 9,999 entries, and more than one CAPE Declaration may be submitted.<\/p>\n<p data-start=\"2164\" data-end=\"2411\">Notes:<br \/>\n\u2022 The list of entries must be free of duplicates prior to submission of the .CSV file<br data-start=\"2256\" data-end=\"2259\" \/>\u2022 The file must be separated by importer of record (if more than one) or by customs broker (if there are multiple parties responsible for the entries)<\/p>\n<p data-start=\"2413\" data-end=\"2540\"><strong>How will refunds be processed?<\/strong><br \/>\nElectronically, via ACH. To receive the refund, banking information must be registered with CBP.<\/p>\n<p data-start=\"2542\" data-end=\"2768\"><strong>When will refunds be processed?<\/strong><br \/>\nCBP estimates that refunds will generally be processed within 60 to 90 days after submission of the CAPE Declaration.
