Protection of Personal Data

Today, 02/11/2022, Constitutional Amendment No. 115/2022 was published, it expressly includes the protection of personal data among the fundamental rights and guarantees and also establishes the exclusive jurisdiction of the Federal Government to legislate on the protection and processing of personal data.

This measure strengthens the system of protection of privacy and personal data, as an unamendable provisions, and seeks to avoid legal uncertainty brought about by the proliferation of rules emanating from the states.
