Our partner Bernardo Pedrete gave an interview to Futuro da Saúde, commenting on the law that approved the transformation of the Brazilian National Data Protection Authority (ANPD) into a regulatory agency.
The change is expected to result in increased oversight of clinics, hospitals, health insurance providers and healthtech companies, ensuring compliance with the Brazilian General Data Protection Law (LGPD).
Pedrete states that the transformation represents a milestone: “If the risk was previously mitigated due to the ANPD’s limited staff, it is now expected that not only large technology companies will be subject to oversight, but also companies from other sectors and smaller-sized businesses,” he assesses.
The partner emphasizes that the measure encourages the adoption of structured privacy policies, compliance programs and a robust data protection culture within the healthcare sector. The interview reinforces that, in a scenario involving sensitive data and increasing digitalization, technological innovation and legal certainty must go hand in hand, ensuring protection and efficiency in services provided to the population.
