The Tribunal of the Administrative Council for Economic Defense ruled, on February 11, on two cases involving the Brazilian Football League (LIBRA) and the current Futebol Forte União (FFU), addressing whether the formation of these entities required prior submission to antitrust review by the competition authority.
By unanimous decision, the Administrative Tribunal held that the transactions should have been previously notified and approved a settlement with the leagues, which assumed obligations before the authority, thereby closing the cases.
The matter has been widely covered in the specialized press, given its implications for associative models, governance structures and the organization of the sports market from a competition law perspective.
The judgment also marked the final session of Council Member Victor Fernandes, who is leaving the Administrative Council for Economic Defense to assume the position of National Secretary for Digital Rights at the Ministry of Justice.
