Will AI Provide Diagnoses? Understanding the New CFM Resolution

The new regulation on artificial intelligence in medicine has gained prominence in the press and featured analysis by our partner Aline Coelho.

Portal Viva published a special report on Resolution No. 2.454/2026 of the Federal Council of Medicine, which establishes guidelines for the use of AI in medical practice throughout the country. The regulation reinforces physicians’ autonomy, requires transparency with patients, imposes governance criteria and determines strict compliance with the Brazilian General Data Protection Law (LGPD).

In the report, Aline assesses that the measure represents an important step toward organizing the use of technology in healthcare, without losing sight of ethical and regulatory boundaries. According to her, the regulation’s main merit is to provide legal support to healthcare professionals.

“One very important aspect of the regulation is that artificial intelligence does not replace the physician. It does not replace medical knowledge, nor does it replace the relationship with the patient.”

The article also addresses key points such as the risk classification of AI systems, the creation of internal committees within healthcare institutions, the application of the concepts of privacy by design and privacy by default, as well as the duty to clearly inform patients about the use of their data.

The discussion reinforces that technological innovation and legal certainty must go hand in hand — especially in a sector as sensitive as healthcare.
